Abstract

With the expansion of the power of interpreters in the current Brazilian scenario, judicial action starts to take political outlines usurping the roles of other powers. The 1988 Democratic Constitution and its normative force becomes an instrument that justifies judicial discretion. From the notorious artifice of using the constitutional text, we live in the era of Juristocracy, as the Ran Hirschl points out. The purpose of this article is to take a critical look at the democratic crisis experienced by the Brazilian Democratic State of Law, from the heightened role of the Judiciary. There is also an analysis of the performance of the Federal Supreme Court in ADPF 347 from the recognition of the Unconstitutional State of Things.
